Divorce is hard. The most important decision you will make when faced with one is picking the right attorney for you. It is important to have someone that will fight for you every step of the way and understands how to effectively take things to the courtroom if there is any disagreements from your spouse. In addition, if you are trying to modify your parenting plan, parental responsibility, alimony, child support, or any other issue that was adjudicated by the Court in your case, an attorney who is experienced in seeking this relief is crucial to your success.
Paternity cases can often be more complex than meets the eye. Florida's presumption is that children should spend equal time with both parents. And for the most part, that is how it should be. There are, however, circumstances which do not call for equal parenting time. You should ensure you have an attorney that understands how to rebut that presumption if it is in the best interest of your child(ren).
Relocating within or outside of Florida can be a complex process, particularly when legal requirements and disputes arise. We can assist in helping you navigate Florida’s relocation laws to ensure the best possible chance for relocation. It is critical to understand how the statute works, especially if time is of the essence, and prepare the best case for the court's consideration. On the other hand, we can also help fight relocation if you feel it is best for your child(ren) to stay.
Being arrested for DUI can be an overwhelming and life-altering experience, but you don’t have to face it alone. You need an experienced attorney who routinely defends individuals accused of DUI to protect your rights and your future. There are a number of ways to fight a DUI, such as challenging the traffic stop or officers assertion of your indicators of impairment. Equally as important in your DUI defense (and often neglected) will be your legal team gathering mitigation from inception of the case.
County Court can be terrifying for people. This is often because it is someone's first time dealing with the criminal justice system. Mr. Kennedy takes an personalized approach to every case and treats every one of his cases seriously. Whether negotiating with prosecutors or representing you in court, Mr. Kennedy will advocate aggressively for your rights (while always maintaining the professionalism our Bar requires). It is critical to get an attorney who will fight to minimize the impact on your criminal record and seek dismissals, reductions, or diversion programs where appropriate. Our firm handles all types of misdemeanor charges.
Being arrested for a felony is a serious matter that can have life-changing consequences. We understand the stakes and are dedicated to providing a strong, strategic defense to protect your rights and your future. At this firm, we will thoroughly investigate your case and do what is needed to achieve the best possible outcome for you. This often includes conducting depositions of the witnesses, using investigators to gather information, or filing pretrial motions when needed (such as a Motion to Set or Reduce bond in a serious felony case). Mr. Kennedy remains committed to helping the accused, as often times people are misunderstood and falsely accused.
Navigating a Department of Children and Families (DCF) case in Florida can be overwhelming, especially when your family’s well-being is at stake and accusations are made. We understand the emotional toll these cases can take, and we are committed to protecting your parental rights and fighting for your children.
Facing or seeking an injunction in Florida can be a stressful experience. An attorney who has experience in injunction court (often called DV court) is important because you need someone who knows the rules of evidence and can handle fast paced hearings. Often times discovery tools can be utilized in these cases as well which may help your case. Whether you need protection through a restraining order or are defending against an injunction filed against you, Mr. Kennedy can assist you in securing the desired outcome. We handle all types of injunctions, including those for domestic violence, stalking, harassment, and repeat violence. Our goal is to protect your rights, reputation, and safety while ensuring compliance with Florida’s strict legal requirements.
Receiving a traffic citation in Florida can lead to fines, points on your license, increased insurance rates, and even the potential for license suspension. Mr. Kennedy provides skilled representation for a wide range of traffic violations, including speeding, reckless driving, running a red light or stop sign, improper lane change, and driving without a valid license. We work to minimize or eliminate penalties and seeking dismissal of the ticket where appropriate.
